NOTICE OF SUSPENSION AND IMPOSITION OF RESTRICTIONS ON
NICOLAS TÉTRAULT’S LICENCE (D4139)

Be advised that on December 5, 2022, the OACIQ Discipline Committee ordered that the real estate broker licence of Mr. Nicolas Tétrault, whose establishment is located in Ville Saint-Laurent, be suspended from January 13 to May 12, 2023, for committing the following offences:

Count 1: Between on or about July 24, 2017 and on or about June 13, 2019, failed to comply with the decision rendered by the OACIQ Licence Issue and Maintenance Committee, which provided, among other things, that his practice had to be overseen and supervised by the executive officer of the agency in which he was carrying on his activities, in the same manner as if he were a beginner broker.

Counts 2a), b) and c): On or about June 11, 2018, while his licence was suspended following a decision by the Discipline Committee, performed brokerage acts in connection with three promises to purchase involving three properties.

In addition, the Discipline Committee imposed the following restrictions on Mr. Tétrault’s licence, which will become effective when the 120-day suspension period has been served:

  1. He shall be prohibited from carrying on activities on his own account and from being designated as agency executive officer and/or from acting as one for a period of 12 months following the 120-day suspension period imposed above;
  1. The period referred to in paragraph (a) shall be suspended in the event he suspends or revokes his real estate broker's licence;
  1. He shall be under the direct supervision of his agency executive officer for all transactions carried out during a consecutive and uninterrupted period of 12 months;
  1. The period referred to in paragraph (c) shall start at the end of the 120-day suspension period mentioned above;
  1. Within 10 days following the end of the 120-day suspension period mentioned above, he must send an agreement signed by his agency executive officer, according to which the latter undertakes to carry out the supervision mentioned in paragraph (c) and to provide a monthly report to the OACIQ Inspection Department in accordance with the prescribed model. Should he change agency, he must send a new agreement to the Inspection Department, in which the agency executive officer undertakes to carry out the supervision mentioned in paragraph (c) and produce the monthly report referred to in paragraph (e), within 10 days following the agency change.
