Clear up any confusion during Open House visits
The OACIQ is concerned by the actions of some brokers or agencies representing sellers with regards to Open Houses, having observed that some do not know the proper way to handle potential buyers who go to Open Houses. This is creating a lot of unnecessary confusion, sometimes even leading to disputes.
The purpose of the Open House is to allow a maximum number of potential buyers to take an interest in a property. Always remember that a buyer who goes to an Open House can do so on his own. He may also do so through a real estate broker who represents him under a brokerage contract or through a collaborating broker without a contract.,
In the absence of a brokerage contract to purchase, it is highly advisable for a collaborating broker without a contract to accompany the buyers to an Open House visit. If this is not possible, the broker should at least instruct his clients to mention to the seller’s broker once they get there that they are already working with a broker.
When a buyer visits an Open House through a broker who represents him under a brokerage contract to purchase, the broker’s presence is highly recommended. However, if the buyer goes alone, he is bound by his brokerage contract to purchase to disclose that he is represented by a broker.
In conclusion, always remember that a buyer may do business with the real estate agency or broker of his choice. He cannot be bound to the seller’s broker under the rule prohibiting double representation, unless an exception applies.
