Residential swimming pool safety: Regulatory framework
To comply with regulatory requirements, residential swimming pool owners have until September 30, 2026, to ensure that all their installations meet current standards, regardless of when they were built.
The Residential Swimming Pool Safety Regulation establishes strict rules to ensure pool safety, particularly regarding the following elements:
- Enclosure fencing, including gates and locking systems
- Installations located near the swimming pool, including operating devices, platforms, terraces, ladders, and diving boards
Sound professional practices for real estate brokers
The practice of declaring, on the Declarations by the seller of the immovable form, any notice of non-compliance that may incur costs to modify current installations remains unchanged. It should be noted that each municipality may adopt rules and penalties that are stricter than those set out in the provincial regulation. It is therefore essential for real estate brokers to carry out the necessary verifications with the relevant municipality whenever a residential swimming pool is involved.
