Amendments to the Real Estate Brokerage Act – Bill 92

The Real Estate Brokerage Act (REBA) was amended on June 4, 2025.

The main purpose of these amendments is to provide the OACIQ with additional resources to carry out its public protection mandate.

Five new measures:

  1. The OACIQ may refuse to issue a new licence, to suspend a licence, revoke it or impose restrictions or conditions thereon if, in the OACIQ's opinion, the applicant (or active licensee) does not have the necessary probity to carry on his activities and to ensure the protection of the public (sections 37 and 38 of the REBA have been amended).
  2. Increase in disciplinary fines for all violations of the REBA and its regulations:
    1. Minimum of $2,500 to a maximum of $62,500 per offence (s. 98 par. of the REBA is amended).
  3. Extending the scope and amount of penal fines to any violation of the REBA and its regulations:
    1. Natural person: minimum of $2,500 to a maximum of $62,500 per offence.
    2. Legal person: minimum of $3,500 to a maximum of $125,000 per offence.
    3. Increase in fines for illegal real estate brokerage:
      1. Natural person: minimum of $3,000 to a maximum of $150,000.
      2. Other cases: minimum of $5,000 to a maximum of $200,000 (s. 124 and 125 of the REBA are replaced, s. 126 and 127 of the REBA are amended).
  4. Obligation for the OACIQ Discipline Committee to impose a fine of at least $2,500 on a licensee found guilty of not disclosing a conflict of interest (s. 98 of the REBA is amended).
  5. Possibility of imposing specific disciplinary or penal fines for violations of certain regulatory provisions, but these fines may not exceed those established by the REBA (s. 125.1 is added, s. 98 of the REBA is amended).

It should be noted that these amendments to the Real Estate Brokerage Act have no direct impact on the everyday practices of brokers and agencies regarding the carrying out of real estate transactions. More specifically, no real estate brokerage form has been modified or added.
