Authorized representative in Québec

The Real Estate Brokerage Act (REBA) was amended on June 11, 2026.

These amendments now allow:

  • OACIQ licence holders to establish themselves elsewhere in Canada without having to maintain an establishment in Québec, provided they appoint an authorized representative in Québec
  • A real estate broker or agency from another Canadian province or territory applying to the OACIQ for a licence to carry out real estate brokerage activities in Québec to no longer be required to have an establishment in Québec if they appoint an authorized representative in Québec

IMPORTANT

  • The authorized representative must reside in Québec. He must therefore have either an establishment or a residential address in Québec
  • In all cases, real estate brokers and agencies located outside Québec and holding an OACIQ licence remain subject to the same professional requirements as those who have an establishment in Québec

Role of the authorized representative in Quebec

The role of the authorized representative in Québec is primarily administrative.

For example, the authorized representative may:

  • Receive notices
  • Receive summonses
  • Receive the service or notification of official documents in Québec

The OACIQ licensee is responsible for ensuring smooth information exchanges with their authorized representative.

The authorized representative may be:

  • An individual or a professional residing in Québec
  • A company established in Québec

The authorized representative does not carry out brokerage activities. The representative is not required to obtain an OACIQ licence to act in that capacity.

Regulation on labour mobility 

The Regulation on labour mobility will come into force on June 30, 2026.

This regulation, adopted in accordance with the Mobility Act 2025, sets out measures to facilitate the processing of licence applications submitted to the OACIQ by real estate brokers or agencies from other provinces or territories of Canada.  The conditions for issuing licences to these individuals are essentially the same as those applicable to Québec applicants, particularly regarding French language proficiency and probity requirements. 

As stipulated in the regulation, real estate brokers from other Canadian provinces and territories will be required to demonstrate that they have the specific knowledge required to practise real estate brokerage in Québec. To this end, they will be required to complete training courses prescribed by the OACIQ on the specific aspects of real estate brokerage practice in Québec. This approach replaces the interprovincial examination, which will therefore be abolished. More details to come.
