A brokerage contract must be signed before advertising the sale of a property, whether on an information listing service for brokers and agencies, a website, or social media. Real estate brokers must be cautious when sellers provide property photos directly. They must obtain a signed copy of the contract or permit between the client and the photographer to ensure that the use of photos by third parties is authorized and complies with the specified terms and conditions.
Publications on social media such as “Coming on Centris” or “Coming soon on Centris” are not authorized until the brokerage contract is signed and the listing of the property on the information listing service is completed.
If the client agrees, a property must be listed on an information listing service when the marketing of the property begins, which means when the broker starts fulfilling the brokerage contract to sell.
The seller must be informed of his right to use such a service and, where applicable, and of the consequences of refusal (e.g. reduced visibility) and document the file, including any warnings provided. It should be noted that marketing cannot begin while delaying the listing, except for exceptional reasons explicitly stated in the contract.
In addition, advertising a property for sale must not be confusing, incomplete or contain false information.
Remember that every broker is required to promote his selling client’s interests, including by offering him the best possible visibility for his property.
