3 Residential leasing

3.8.4 Eviction

The lessor of a dwelling may evict the lessee to subdivide the dwelling, enlarge it substantially or change its destination.1 However, the Act to limit lessors' right of eviction and to enhance the protection of senior lessees (Bill 65) prohibits lessors from exercising this right for a period of three years since June 6, 2024.2

In a notice of eviction, the reason for and the date of eviction shall be indicated.3

The periods are the same as for the repossession of a dwelling.4

If the lessee does not respond, he is deemed to have refused to vacate the dwelling.5

Article 1965 of the Civil Code of Québec provides that the lessor shall pay the lessee reasonable moving expenses and an indemnity equal to one month's rent for each year of uninterrupted lease, without exceeding 24 months’ rent or being less than 3 months' rent.

Unless the Administrative Housing Tribunal decides otherwise, the indemnity is payable at the expiry of the lease and the moving expenses are payable upon presentation of receipts.

If the lessee considers that the injury suffered warrants greater indemnity, he may apply to the court to have the amount fixed.
