NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON GHISLAIN BÉLISLE’S LICENCE
NOTICE is hereby given that Ghislain Bélisle, real estate broker, licence C7357, whose establishment is located in Joliette, has had conditions and restrictions imposed on his licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.
On July 21, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Mr. Ghislain Bélisle:
a. For a period of 36 months following notification of this decision, the licence holder shall be prohibited from carrying on activities on his own account or from being designated as agency executive officer and/or from acting as one.
b. For a period of 36 months following notification of this decision, the licence holder shall enter into and maintain a written agreement with the agency on behalf of which he carries on his professional activities, to the effect that the latter holds in trust the GST/QST payable to him, as real estate broker, until he is required to remit these taxes together with his return.
c. For a period of 36 months following the notification of this decision, the licensee shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust a percentage of his compensation to pay his taxes. The percentage shall be agreed upon between the licensee and his agency.
d. A copy of the agreement mentioned in paragraphs b) and c) shall be sent to the OACIQ Registry Service within thirty (30) days of the notification of this decision.
e. In the event of any agency change during the period mentioned in paragraphs b) and c), the licensee must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
f. The period referred to in paragraphs a), b) and c) shall be suspended in the event the licensee suspends or revokes his real estate broker's licence.
g. The period referred to in paragraphs a), b) and c) shall end when the holder accumulates 36 months as an active real estate broker’s licence holder as of the notification of this decision.
h. Within a 60-day period following notification of this decision, the licensee shall send the Organization’s Registry Service a copy of the amendment to the Registraire des entreprises du Québec showing that he is no longer a director and/or shareholder of 9085-0876 Quebec Inc.
i. The licence holder shall send his certificate of discharge from bankruptcy to the OACIQ Registry Service within 30 days of his discharge.
j. Should the licence holder not be discharged from his bankruptcy by August 17, 2022, his file will be resubmitted to the Committee.
Should Mr. Ghislain Bélisle fail to comply with the above conditions and restrictions, his right to engage in real estate brokerage activities shall be suspended until he does so.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.
The decision became enforceable on August 11, 2022.
