NOTICE OF SUSPENSION
OF MR. RICARDO JEBB BRUNO’S LICENCE

NOTICE is hereby given that Mr. Ricardo Jebb Bruno, former real estate broker (licence no. E3768) whose establishment is located in Laval, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: concerning an immovable, having engaged in real estate acts or practices, of which the purpose is to make profits by reselling the said immovable that is not yet acquired:

a) at an unknown date, by concluding an agreement with a third person under which the latter would accept to act as a front man in exchange for an amount of money;

b) on or around July 23, 2008, by completing or allowing someone to complete on behalf of a third person, then subsequently sign by the latter, the “Promise to purchase” document sent by the seller to the defendant who should originally buy the said immovable himself;

c) on or around July 24, 2008, by sending or allowing someone to send to a mortgage lender the said document “Promise to purchase” on behalf of the promising buyer; 

d) during August 2008, but presumably on August 15, 2008, by completing or allowing someone to complete a Promise to purchase between a promising buyer and a designated seller, third person, whereas he knew or should have known that the latter was not the immovable’s owner registered in the Land Register;

e) on or around August 20, 2008, by completing or allowing someone to complete on behalf of a promising buyer, the “Promise to purchase” document sent by a seller to the defendant who should originally buy the said immovable himself; 

f) on or around August 28, 2008, by sending or allowing to be sent to an agency the said document “Promise to purchase” on behalf of the promising buyer;

the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

2nd count: As of or around July 24, 2008, concerning an immovable, having sent or allowing someone to send to a mortgage lender documents or information concerning a borrower , which he knew or should have known to be false;

the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: As of or around August 28, 2008, concerning an immovable, having sent or allowing to be sent to an agency documents or information concerning a borrower, which he knew or should have known to be false;

the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

4th count: Concerning an immovable, failing:

a) prior to the signing of a “Promise to purchase” document by a seller, on or around July 23, 2008, to show in writing and without delay that he is acting as a real estate broker and his direct or indirect interest in the immovable he was offering to buy in accordance with the terms set out in section 81 of the ACAIQ By-law;

committing an offence under section 22 of the Québec Real Estate Brokerage Act

b) as of or around July 23, 2008, failing to send as soon as possible to the ACAIQ a copy of the written notice of disclosure and a copy of the “Promise to purchase” document;

committing an offence under section 23 of the Québec Real Estate Brokerage Act.

On November 30, 2012, the Discipline Committee ordered a permanent suspension of Mr. Ricardo Jebb Bruno’s real estate broker’s licence (E3768) on all the counts of the formal complaint, enforceable as of the date the decision is served on the defendant. The Committee also prohibited him from applying again for any real estate broker’s licence (or any type of licence) issued under the Real Estate Brokerage Act.

The permanent suspension of Mr. Ricardo Jebb Bruno’s real estate broker’s licence and the ban imposed by the Committee take effect as of January 24, 2013.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
