NOTICE is hereby given that Mark Di Giovanni, former real estate broker (Licence No. F0129), whose establishment was located in Montréal, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: On or about December 2011, concerning a property, Defendant allowed or encouraged the illegal practice of real estate brokerage activities, namely:

a) by letting and/or tolerating his name to appear in section 2.1 of the promise to purchase as the representative of the agency, while he knew or should have known that the said promise to purchase had been completed by a person who was not then licensed by the OACIQ;

b) by letting a person who was not then licensed by the OACIQ, present and/or participate in the presentation of the promise to purchase;
thus committing, on each of the above mentioned occasions, an offence under section 7 and 104 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

On November 25, 2014, the Discipline Committee ordered the suspension of Mark Di Giovanni’s real estate broker’s licence (Licence No. F0129) for a period of thirty (30) days on each of counts No. 1a) and 1b) of the complaint, to be served concurrently with each other.

Given that Mark Di Giovanni is no longer a licence holder, his licence will be suspended for a period of 30 days whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
