NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON CAROLINE LEBEL’S LICENCE

NOTICE is hereby given that Caroline Lebel, real estate broker, licence G9232, whose establishment is located in St-Jean-sur-Richelieu, has had conditions and restrictions imposed on her licence, following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 38 (2) of the Real Estate Brokerage Act.

On September 20, 2023, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Ms. Lebel:
 
  1. Within 6 months of notification of this decision, she must complete the training course entitled “The broker as a self-employed worker,” provided by the OACIQ Training Department.
 
  1. Within 30 days of notification of this decision, she shall send the OACIQ Registry Service proof of her registration for the training mentioned in paragraph (a).
 
  1. Within 90 days of notification of this decision, the licensee must take the training course "Finances personnelles pour tous par McGill" and send proof of completion to the OACIQ Registry Service.
 
  1. She will be prohibited from acting on her own account for up to 36 months after her discharge from bankruptcy.
 
  1. Up to 24 months following her discharge from bankruptcy, the licensee shall enter into and maintain a written agreement with the agency within which she carries on her real estate brokerage activities to the effect that the latter retains the GST and QST payable to her, until she is required to remit them upon transmission of a copy of her tax return to be kept in the agency's file.
 
  1. Up to 24 months following her discharge from bankruptcy, the licensee shall enter into and maintain a written agreement with the agency within which she carries on her real estate brokerage activities to the effect that the latter holds a percentage of her remuneration to pay her taxes, until she is required to remit it upon transmission of her notices of assessment, or in order to make instalment payments.
 
  1. A copy of the agreement mentioned in paragraphs (e) and (f) shall be sent to the OACIQ Registry Service within thirty (30) days of the notification of this decision.
 
  1. In the event of any agency change during the period mentioned in paragraphs (e) and (f), the licensee must enter into a new agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.
 
  1. Within 30 days of notification of this decision, the licensee shall send the OACIQ Registry Service proof that her credit card has been submitted to the bankruptcy trustee for cancellation.
 
  1. She shall send a copy of the proof of discharge from bankruptcy to the OACIQ Registry Service.
 
  1. Should the licensee not be discharged from her bankruptcy by February 18, 2025, her file will be resubmitted to the Committee.

If Ms. Lebel fails to comply with the conditions and restrictions imposed, her right to engage in real estate brokerage activities shall be suspended until she does so.

This notice is given in accordance with section 33 of the Regulation respecting broker’s and agency licences.

The decision became enforceable on October 26, 2023.
