NOTICE is hereby given that Mr. Wing Yiu Leung, affiliated real estate agent (Certificate No. C2537), formerly employed by or authorized to act on behalf of Century 21 Vision, chartered real estate broker (C5975), whose establishment is located at 5517 Monkland Street, in Montréal, has notably been found guilty by the Discipline Committee of the Association des courtiers et agents immobiliers du Québec of the offences summarized below:

3rd count: On or about June 4th, 2006, concerning an immovable, completing the promise to purchase and obtaining the signature of the buyer on same, without:

c) suggesting to the buyer that his deposit be secured into a trust account;

the whole contrary to sections 1, 13 and 29 of the Rules of Professional Ethics of the ACAIQ.

5th count: On or about August 7th, 2006, failing to respect his commitment to disburse the amount of $23,000 to the seller in regard to the purchase of an immovable;

the whole contrary to sections 1 and 13 of the Rules of Professional Ethics of the ACAIQ.

On February 24, 2009, the Discipline Committee ordered a suspension of Mr. Wing Yiu Leung’s certificate for a period of thirty (30) days on the count no. 3 c) of the complaint and a suspension for a period of sixty (60) days on the count no. 5 of the complaint, to be served concurrently.

The decision of the Discipline Committee is enforceable from the date of the appeals deadline, i.e. April 6, 2009. The suspension of Mr. Wing Yiu Leung’s affiliated real estate agent’s certificate is therefore effective as of April 6, 2009 for a period of sixty (60) days.

Should the defendant’s certificate be suspended or expired at the date of the appeals deadline, the above restrictions from applying for reinstatement or issuance of a real estate broker’s or agent’s certificate shall become effective only at the time of such application.

This notice is given in accordance with section 137 of the Real Estate Brokerage Act (R.S.Q., c. C-73.1).
