NOTICE OF SUSPENSION OF THE LICENCE OF MR. PIERRE DESROCHES

NOTICE is hereby given that Mr. Pierre Desroches, having been the holder of a chartered real estate agent’s certificate (C2275) and having practiced in an establishment located in Saint-Sauveur, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec of the offences summarized below:

1st count: Beginning in the month of April 2006, during negotiations leading to the sale of an immovable of which he was the owner, failing to disclose to the promising buyers that:
a) the heated tile floor in the kitchen needed to be redone;
b) the in-ground pool needed to be demolished and rebuilt;
the whole contrary, for each sub-paragraph, to the provisions of sections 1, 13, 24, 26, 28 and 29 of the Rules of Professional Ethics of the ACAIQ.

2nd count: Beginning in the month of April 2006, concerning an immovable, failing to avoid placing himself in a conflict of interest, namely by accepting to represent the promising buyers whereas he was the owner of the immovable and was representing the listing real estate broker entrusted with the sale of this immovable;
the whole contrary to the provisions of sections 1 and 5 of the Rules of Professional Ethics of the ACAIQ.

On December 1, 2010, the Discipline Committee ordered a suspension of Mr. Pierre Desroches’s real estate broker’s licence for a period of three (3) months on count No. 1 a) of the complaint, a suspension for a period of three (3) months on count No. 1 b), and a suspension for a period of three (3) months on count No. 2, to be served concurrently as of the date of the appeals deadline if the defendant is the holder of a licence issued by the OACIQ or, if not, whenever he becomes a licence holder again.

Given that Mr. Pierre Desroches does not hold a licence, his licence shall be suspended for a period of three (3) months whenever he becomes a licence holder again.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences.
