NOTICE OF SUSPENSION
OF THE LICENCE OF MRS. FLOAREA PETRESCU

NOTICE is hereby given that Mrs. Floarea Petrescu (Licence No. D7501), whose establishment was located in Montréal, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec of the offences summarized below :

1st count: On or around October 29, 2008, concerning an immovable, receiving compensation directly from a person other than the holder of a chartered real estate broker’s certificate who employed her or authorized her to act on his behalf, by receiving directly from the promising buyers of the said immovable an amount of $4,000, the whole contrary to section 72 of the By-Law of the ACAIQ.

2nd count: Concerning an immovable, making false statements during an investigation conducted by an assistant syndic, notably by declaring:

a) On or around February 13, 2009, in a statement made to an investigator:
[tr.] “During this visit, I asked the promising buyers for the $4,000 I had loaned to them”;

b) On or around April 16, 2009, in a statement made to an investigator:
[tr.] “I loaned $4,000 to the promising buyers’ family in September 2007, a cheque for $3,500 and $500 in cash. I was reimbursed in October 2008 and I signed this statement on October 29, 2008. »;

c) On or around May 25, 2009, in a statement made to the assistant syndic:
[tr.] “The $4,000 loan I made to the promising buyers’ family was to enable them to do some renovation work.”;

thus committing, on each occasion, an offence under section 55 of the Rules of Professional Ethics of the ACAIQ.

On November 16, 2011, the Discipline Committee ordered a suspension of Mrs. Floarea Petrescu’s real estate broker’s licence for a period of thirty (30) days on count No. 1 of the complaint, and concurring periods of thirty (30) days on each of counts Nos. 2 a), 2 b) and 2 c), to be served consecutively to the period ordered in count No. 1 as of the appeals deadline if she is the holder of a licence issued by the OACIQ or, if not, whenever she becomes a licence holder again.

Given that Mrs. Floarea Petrescu is no longer a licence holder, her licence will be suspended for a period of sixty (60) days whenever she becomes a licence holder again.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q. c. C-73.2, r.3).
