NOTICE OF SUSPENSION OF
MR. ROBERT AUDET’S LICENCE

NOTICE is hereby given that Mr. Robert Audet, former real estate broker (licence no. D0087) whose establishment is located in Rouyn-Noranda, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: between on or around August 4, 2008 and on or around November 2, 2009, concerning a property, having transmitted or had someone transmitted to the multiple listing service an information he knew or should have known that it is false, the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

2nd count: as of or around June 15, 2009, concerning an immovable, failing to inform the real estate agent representing the prospective buyer of the existence of a promise to purchase, committing offences against:

a) the seller;

b) the prospective buyer;

c) the real estate agent;

violating thus, on each of these occasions, section 24 of the Rules of Professional Ethics of the ACAIQ.

5th count: as of or around June 6, 2010, concerning an immovable, failing to inform the real estate agent representing the prospective buyers of the existence of a promise to purchase, committing thus offences against:

a) the seller;

b) the prospective buyers;

c) the real estate agent;

violating thus, on each of these occasions, section 24 of the Rules of Professional Ethics of the ACAIQ.

On July 18, 2012, the Discipline Committee ordered a suspension of Mr. Robert Audet’s real estate broker’s licence for a period of thirty (30) days on count no. 1 of the complaint, and a suspension for a concurrent period of thirty (30) days on each of the counts no. 2 a), 2 b) and 2 c) and a suspension for a concurrent period of thirty (30) days on each of the counts no. 5 a), 5 b) and 5 c). These suspension periods shall be served consecutively with each other as of the date of the appeals deadline if the defendant is the holder of a licence issued by the OACIQ or, if not, whenever he becomes a licence holder again.

Given that Mr. Robert Audet is no longer a licence holder, his licence will be suspended for a period of ninety (90) days whenever he becomes a licence holder again.

This notice is given in accordance with section 98.1 of the Real Estate Brokerage Act (R.S.Q., c. C-73.2) and section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
