NOTICE OF SUSPENSION OF
MR. GAÉTAN LAFLÈCHE’S LICENCE

NOTICE is hereby given that Gaétan Laflèche, former real estate broker (Licence No. B2460), whose establishment was located in Sherbrooke, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: Concerning an immovable:

a) at an unknown date falling on or prior to May 30, 2008, participated and/or forged an invoice bearing the header of another real estate broker to obtain the payment of remuneration;

c) on or around July 2, 2008, required that a formal demand be sent to the seller to obtain the payment of the said amount of $3,000;

d) on or around April 16, 2009, took legal action against the seller to obtain the payment of the said amount of $3,000;

and this unbeknownst to said real estate broker that employed him or authorized him to act on its behalf; thus committing an offence under section 13 of the Rules of Professional Ethics of the ACAIQ as to count No. 1 c) and offences under section 72 (2) of the ACAIQ’s By-laws as to the other paragraphs of count No. 1.

2nd count: As of or around March 14, 2008, concerning an immovable, did not immediately send to the manager of the establishment to which he was assigned the information and documents necessary for maintaining records, books and registers, namely:

a) a promise to purchase and an Annex A;

b) a counter-proposal to a promise to purchase;

c) an Annex G;

committing, on each of these occasions, an offence under section 147 of the ACAIQ’s By-laws.

3rd count: As of May 17, 2010, concerning an immovable, did not respect the commitment made to an analyst of the OACIQ Assistance Department, i.e. to file to the Court a withdrawal of his request, thus committing an offence under section 105 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

On August 14, 2014, the Discipline Committee ordered the suspension of Gaétan Laflèche’s real estate broker’s licence (Licence No. B2460) for a concurrent period of ninety (90) days on each of the counts Nos. 1a),1c) and 1d) and for a concurrent period of thirty (30) days on each of the counts Nos. 2a), 2b) and 2 c), to be served concurrently with each other and a period of thirty (30) days on count No. 3 of the formal complaint, to be served consecutively.

Given that Gaétan Laflèche is no longer a licence holder, his licence will be suspended for a period of one hundred and twenty (120) days whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
