NOTICE OF SUSPENSION OF
MR. SERGE SIMONEAU’S LICENCE

NOTICE is hereby given that Serge Simoneau, former real estate broker (Licence No. E3889), whose establishment was located in Brossard, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: On or around February 1, 2011 and on or around May 14, 2011, concerning a third party which was not an OACIQ licence holder:
a) Facilitated, allowed and/or encouraged this third party to carry out real estate brokerage transactions;

Committing an offence under section 104 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

2nd count: Concerning a borrower’s financing request:
a) on or around February 1, 2011, carried out or attempted to carry out brokerage transactions on behalf of a company;
while the said company was not an OACIQ licence holder, committing an offence under section 104 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

3rd count: On or around July 3, 2011, concerning a borrower’s financing request, carried out or attempted to carry out brokerage transactions on behalf of a company, which was not an OACIQ licence holder, the whole contrary to section 104 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

4th count: On or around July 13, 2011, concerning a borrower’s financing request, failed to deposit immediately in a trust account the amount of $1,139.25, thus committing an offence under section 26 of the Regulation respecting records, books and registers, trust accounting and inspection of brokers and agencies.

5th count: As of or around June 12, 2012, during an investigation conducted by an assistant syndic, while he had agreed to send him the file of a borrower, failed and/or neglected to fulfill his commitment, committing an offence under section 105 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising.

On April 8, 2014, the Discipline Committee ordered a suspension of Serge Simoneau’s real estate broker’s licence (Licence No. E3889) for periods of thirty (30) days each as to counts Nos. 1 a), 2 a), 3, 4 and 5 of the formal complaint, to be served consecutively with each other

Given that Serge Simoneau is no longer a licence holder, his licence will be suspended for a period of one hundred and fifty (150) days whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., C-73.2, r.3).
