NOTICE OF SUSPENSION
OF THE LICENCE OF MRS. NATALIA KORTCHEVNAIA

NOTICE is hereby given that Mrs. Natalia Kortchevnaia, former affiliated real estate agent (Certificate No. D4526), and formerly employed by or authorized to act in an establishment located in Dollard-des-Ormeaux, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec of the offences summarized below:

1st count: Concerning an immovable, having:
a) allegedly on or about November 9th, 2005, signed a promise to purchase and the Annex A, as buyer, indicating a selling price, while she knew or should have known that it did not represent the real selling price agreed by the parties;
b) allegedly on or about November 9th, 2005, signed a promise to purchase and the Annex A, as buyer, while she knew or should have known that the deposit indicated on section 4.2 of the said promise to purchase was not made;
the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

2nd count: Between November 9th, 2005 and February 8th, 2006, concerning an immovable, having transmitted or had documents transmit to a financial institution, while she knew or should have known that they were false, namely:
a) a letter “Attestation d’emploi” dated January 9th, 2006, and allegedly signed by her former real estate broker;
b) a notice of assessment for the year 2004;
c) a notice of assessment for the year 2003;
d) a notice of assessment for the year 2002;
e) an investment confirmation dated July 6th, 2005, allegedly from a bank;
f) a lease for an apartment, for the period beginning on March 5th, 2002, ending on an unknown date and allegedly signed on March 5th, 2002;
g) a lease for an apartment, for the period beginning on June 1st, 2002, ending on June 1st, 2007, and allegedly signed on May 9th, 2002;
h) a promise to purchase on which the section 4.2 concerning the deposit was not completed together with Annex A on which the section A 3.1 does not indicated any deposit;
the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

4th count: Concerning an immovable, having:
a) on or about June 12th, 2005, modified the Multiple Listing Service in order to increase the selling price of this immovable without having in her possession the proper documentation justifying said increase;
b) on or about June 21st, 2005, had the seller sign a promise to purchase and an Annex A indicating a selling price while she knew or should have known that it did not represent the real sellling price agreed by the parties;
c) let two different versions of an Annex A dated of June 21st, 2005, circulate;
the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

On February 4th, 2011, the Discipline Committee ordered a suspension of Mrs. Natalia Kortchevnaia’s licence for a period of six (6) months on count No. 1, for a consecutive period of one (1) year on count No. 2 and for a consecutive period of ninety (90) days on count No. 4, to be served from the date of the appeals deadline if the defendant is a holder of a licence delivered by the OACIQ, or, in defect, as she will become again a holder.

The suspension of Mrs. Natalia Kortchevnaia’s real estate broker’s licence will be effective when she will become again a holder of a licence for a period of one (1) year, six (6) months and ninety (90) days.

This notice is given in accordance with section 98.1 of the Real estate brokerage act (L.R.Q., c. C-73.2) and with section 33 of the Regulation respecting the issue of broker’s and agency licences.
