NOTICE OF IMPOSITION OF CONDITIONS AND RESTRICTIONS
ON CLAUDE DUGUAY’S LICENCE

NOTICE is hereby given that Claude Duguay, residential real estate broker, licence number C5785, whose establishment is located in Quebec City has had conditions and restrictions imposed on his licence following a decision by the Licence Issue and Maintenance Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), pursuant to section 37 (2) of the Real Estate Brokerage Act.

On July 21, 2022, the Licence Issue and Maintenance Committee imposed the following conditions and restrictions on Claude Duguay’s licence:

a. For a period of 48 months following his licence issuance, prohibiting him from carrying on activities on his own account and from being designated as agency executive officer and/or from acting as one.

b. For a period of 48 months following his licence issuance, the applicant shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust the GST and QST payable to him, as real estate broker, until he is required to remit them along with his tax return.

c. For a period of 48 months following his licence issuance, the applicant shall enter into and maintain a written agreement with the agency within which he carries on his activities to the effect that the latter holds in trust a percentage of his compensation to pay his taxes. The percentage shall be agreed upon between the applicant and his agency.

d. A copy of the agreement mentioned in paragraphs b) and c) shall be sent to the OACIQ Registry Service within thirty (30) days of the issuance of his licence.

e. In the event of any agency change during the period mentioned in paragraphs b) and c), the applicant must enter into an agreement under the same conditions with the new agency and send a copy thereof to the Organization’s Registry Service within 30 days following the agency change.

f. The period referred to in paragraphs a), b) and c) shall be suspended in the event the applicant suspends or revokes his real estate broker's licence.

g. The period referred to in paragraphs a), b) and c) shall end when the applicant accumulates 48 months as an active real estate broker’s licence holder as of the issuance of his licence.

h. For his first six transactions, the applicant shall be under the direct supervision of his agency executive officer or of an experienced broker designated by his agency executive officer.

i. Within 30 days of his licence issuance, the applicant shall send a letter to the Organization’s Registry Service stating that his agency executive officer undertakes to supervise him as referred to in paragraph h).

j. In the event of an agency change before the completion of the six transactions, the applicant shall, within 30 days following the change, provide a letter in which his new agency executive officer undertakes to carry out the supervision mentioned in paragraph h).

If the applicant fails to comply with the conditions and restrictions imposed, his right to carry out real estate brokerage activities will be suspended until he does so.

This notice became enforceable on August 11, 2022.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences.
