Foreword

The practice of real estate leasing brokerage presents a number of differences compared to the sale and purchase of real estate property. However, the ethical obligations of the licence holder remain the same. According to section 73 of the Regulation respecting brokerage requirements, professional conduct of brokers and advertising:

In carrying on activities, a broker or agency executive officer must take into account his aptitudes, limits on knowledge and means available. He must not engage in a brokerage transaction that is outside of his field of expertise without seeking the necessary assistance, including from another licence holder having the required skills
 

A broker who does not have experience in brokerage transactions involving the leasing of commercial space or residential dwelling units must therefore complete the necessary training to acquire the knowledge and skills needed to carry out this type of transaction, or seek the assistance of a licence holder who has these qualifications.
