NOTICE OF SUSPENSION
OF MRS. RIMMA ALIDZAEVA’S LICENCE

NOTICE is hereby given that Mrs. Rimma Alidzaeva, former real estate broker (licence no. D1803) whose establishment was located in Saint-Laurent, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

3rd count: Concerning an immovable, have participated in a stratagem in order to allow the prospective buyer to obtain a mortgage financing based on false pretenses, namely by:

a) on or about May 1st, 2006, signing, as a seller, a promise to purchase, knowing that another person, also owner of the said immovable, was not identified on the said promise to purchase;
b) on or about May 8th, 2006, signing an exclusive brokerage contract, while a promise to purchase had already been accepted on May 1st, 2006;
c) on or about may 12th, 2006, signing an amendments and notice of fulfillment of conditions to “cancel” an exclusive brokerage contract;

committing an offence to section 13 of the Rules of professional ethics of the ACAIQ.

4th count: Concerning an immovable did not, without delay, send to the person who manages the place of business to which she was assigned, the information and documents that the holder of a chartered real estate broker’s certificate, who employed her or on whose behalf she was authorized to act, requires to maintain required records, books and registers, namely:

a) a promise to purchase and an annex A dated on May 1st, 2006;
b) an exclusive brokerage contract dated on May 8th, 2006;
c) an amendments and notice of fulfillment of conditions dated on May 12th, 2006;

committing, for every and each of the above paragraphs, an offence to section 147 of the By-Law of the ACAIQ.

On March 10, 2010, the Discipline Committee ordered the suspension of Mrs. Rimma Alidzaeva’s real estate broker’s licence (licence no. D1803) for concurrent periods of ninety (90) days each on counts no. 3 a), b) and c) of the formal complaint, and for concurrent periods of thirty (30) days each on counts no. 4 a), b) and c), to be served consecutively to each other.

Given that Mrs. Rimma Alidzaeva is no longer a licence holder, her licence will be suspended for a period of one hundred and twenty (120) days whenever she becomes a licence holder again and consecutively to suspensions to be served in file 33-10-1342.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
