NOTICE OF LICENCE SUSPENSION
NOTICE is hereby given that Normand Pichette, former real estate broker, licence No. D0052, whose establishment was located in Mascouche, has been found guilty by the OACIQ Discipline Committee of the offences summarized below:
Count 1: On or around December 6, 2010, concerning an immovable, completed a brokerage contract designating a company as a seller, while said company was not the owner of said immovable.
Count 2: As of or around December 10, 2010, concerning an immovable, did not send to the real estate agency to which he was assigned all information and documents required to keep records, books and registers, namely a promise to purchase and an annex A.
Count 3: Between on or around February 7 and 17, 2011, concerning an immovable, encouraged or allowed a prospective buyer to sign a promise to purchase at a price of $220,000, without ensuring to inform him in advance that the seller had acquired it on February 15, 2011 for $32,000.
Count 4: On or around February 17, 2011, concerning an immovable, allowed and/or tolerated the payment of a deposit of $44,000 to be mentioned under clause A 3.1 of annex A related to a promise to purchase, while this did not reflect the reality.
Count 5: On or around April 28, 2013, concerning an immovable, drafted an annex and had it signed by a prospective buyer. The annex provided in particular that “the seller undertakes to remit the sum of $11,750 upon the signing of the notarial deed to the buyer (...)”, while the promise to purchase did not contain any reference to said annex.
Count 6: On November 18, 2013 and April 15, 2014, concerning an immovable, did submit his chronological version of facts relating to COMIN-1245 case, as required by Me Luc Pelletier and Me Isabelle Lafrenière.
Count 7: In June 2014, during an investigation conducted by the assistant syndic, failed and/or neglected to show up for a meeting set on June 25, 2014.
On November 11, 2015, the Discipline Committee ordered the suspension of Normand Pichette's licence No. D0052 for a period of 13 months, to be served whenever he becomes a licence holder again.
This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
