NOTICE OF LICENCE SUSPENSION

NOTICE is hereby given that Martin Benoit, former real estate broker, licence No. D7272, whose establishment was located in Terrebonne, has notably been found guilty by the OACIQ Discipline Committee of the offences summarized below:

Count 1: Concerning an immovable, acted blindly or by complacency on the instructions of a third party:

a) on or around November 26, 2013, by drafting and signing a brokerage contract with no real intention to market the immovable;

b) on or around November 28, 2013, by preparing and allowing a description sheet of the immovable to be published based on information and photos provided by a third party without checking their accuracy and/or being able to prove their accuracy.

Count 2 b): Concerning an immovable, on or around November 26, 2013, drafted and signed a brokerage contract and a seller’s declaration in the absence of the seller and/or his representative, without checking if the third party had a written power of attorney to that effect.

Count 3: On or around November 27, 2013, concerning an immovable, did not send or did not ensure to immediately send a promise to purchase to the manager of the business place to which he was assigned.

Count 4: On or around August 28, 2014, concerning an immovable, during an investigation conducted by an assistant syndic, made false statements by claiming that he did not draft the promise to purchase.

On December 4, 2015, the Discipline Committee ordered the suspension of Martin Benoit's licence No. D7272 for a period of 90 days, to be served whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
