NOTICE OF SUSPENSION OF
MR. ALI POOR’S LICENCE

NOTICE is hereby given that Mike Ali Poor, former real estate broker (Licence No. D1329), whose establishment was located in Dollard-des-Ormeaux, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: On or around November 18, 2005, concerning a property, modified the date of signature of the parties mentioned in the following documents:

a)      Brokerage Contract;
b)      Promise to Purchase;

after the parties had already signed the said form, the whole contrary to section 98 of the By-law of the ACAIQ.

4th count: On or around August 15, 2005, concerning a property, had the buyer and the seller sign a Promise to Purchase indicating a selling price while he knew or should have known that it did not represent the real selling price agreed to by the parties, the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

5th count: On or around October 30, 2005, concerning a property, prepared and had the seller and the buyer sign an Amendments and Notice of Fulfillment of Conditions form indicating that: “Buyer and seller mutually agree to release the notary and the listing agent (listing, selling) of any liability in this transaction” [sic], the whole contrary to section 31 of the Rules of Professional Ethics of the ACAIQ.

On February 3, 2015, the Discipline Committee ordered the suspension of Mike Ali Poor’s real estate broker’s licence (Licence No. D1329) for a concurrent period of thirty (30) days on each of counts No. 1 a), and 1 b), a consecutive period of two hundred and seventy (270) days on count No. 4 and a consecutive period of one hundred and fifty (150) days on count No. 5 of the formal complaint.

Given that Mike Ali Poor is no longer a licence holder, his licence will be suspended for a period of four hundred and fifty (450) days whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
