NOTICE OF SUSPENSION OF
MR. PASCAL LEBLANC-SIMARD’S LICENCE

NOTICE is hereby given that Pascal Leblanc-Simard, former real estate broker (Licence No. E0682), whose establishment was located in Laval, has notably been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

2nd count: On or about May 17, 2008, concerning an immovable, signed, as a buyer, a promise to purchase on this immovable, while he was representing the broker who was in charge of marketing the immovable under a brokerage contract, the whole contrary to section 5 of the Rules of Professional Ethics of the ACAIQ.

Count 4: On or about July 12, 2008 and on or about August 24, 2008, concerning an immovable, prepared and had the promising buyers sign promises to purchase, which designated the defendant as representative of the broker acting as an intermediary for the same promising buyers, committing, on each of these occasions, an offence under section 5 of the Rules of Professional Ethics of the ACAIQ.

Count 5: On or about July 12, 2008 and on or about August 24, 2008, concerning an immovable, failed or neglected to complete an “Annex A” form when preparing promises to purchase while a mortgage financing was required by these promising buyers, committing, on each of these occasions, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

Count 7a): Between on or about November 2008 and on or about February 2009, allowed a person who is not an ACAIQ member to solicit the owners of an immovable to offer them certain marketing approaches for their property, in exchange for an amount of money, committing an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

Count 11a): As of the signing of a brokerage contract, on or around December 4, 2008, concerning an immovable, did not respect his ethical obligations, including by entering and/or allowing the information indicated in the detailed description sheet published in the Multiple Listing Service SIA-MLS to be entered without verifying its accuracy, committing an offence under section 11 of the Rules of Professional Ethics of the ACAIQ.

Count 11a): On or about July 29, 2009, concerning an immovable, prepared a second copy of a brokerage contract and falsely indicated therein “January 5, 2009”, as the sellers’ signature date and signed in lieu of sellers on said form, while he and the sellers had really signed the first version of said brokerage contract on January 5, 2009, the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

On February 9, 2015, the Discipline Committee ordered the suspension of Pascal Leblanc-Simard’s real estate broker’s licence (Licence No. E0682) for periods totalling ninety (90) days on counts No. 2, 4a), 4b), 5a), 5b), 7a), 11a), 18 a) and 18b) of the complaint.

Given that Pascal Leblanc-Simard is no longer a licence holder, his licence will be suspended for a period of ninety (90) days whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., c. C-73.2, r.3).
